I had a video online over at The Daily Card Trick. Jerry Sadowitz wrote me an email wishing that I remove the video, as it is material that he uses. I set the video to private so basically nobody could see it. Jerry Sadowitz seemed OK with that compromise. Now the video is removed due to a copyright claim by Jerry Sadowitz.
Here is the thing. It was me in the video, not Jerry. The material although based on his effect had alterations. By alterations I mean I changed the whole damn method. So basically nothing save the effect is by Jerry Sadowitz.
As much as I like the man, I do have trouble believing he can simply take down my content. Thoughts?
EDIT: OK I got things worked out, turns out this was a case of "weird" timing. Jerry filed the copyright complaint against my video, before contacting me. But I got the information from YouTube after both of us had reached an agreement. It took him a while to get my email address. Within ten day my video should be back. But I am going to respect his wishes and make the video unavailable to almost everyone.
Sounds pretty crap to me. I've never net Sadowitz and based on what I've heard I have little desire too.

Step 1) Ask him to prove said copyright, I'm betting he can't
Step 2) File a counter claim with YouTube asking them to prove his copyright. When they can't it will be the end of his days being able to pull crap like this as they will have him tagged for false copyright claims.
*cue Darkstar with some DMCA crap and most likely a pot shot at Tim*
Doesn't sound like that should be possible, so I think technically he might have gotten away with one there. Legally he shouldn't have the ability to do that.
ReplyDeleteIt might be worth respecting his wishes anyway -- he's long been protective of his work in ways that other magicians aren't. It's pretty old school.
Was this an experiment on your part? You do know, and I know you and everyone else knows, that he doesn't like this sort of thing.

ReplyDeleteIt looks to me like he is behaving like a complete twat and is way to wrapped up in his own importance and believes he has some sort of right to dictate to other people about what they can say and do.
It cracked me up when he accused Smiling Mule of stealing his writing style LOL, and apparently no one is allowed to voice opinions that are the same as his opinions. Let's see him try a copyright claim on an opinion or a writing style. What an ass.

ReplyDeleteThat's not what I'm saying at all. My understanding is that when he sells his stuff, he feels it's meant for the magician he sells it to and that magician's audience alone. It's not how myself nor 99% of the magicians I know go about it, but I can still respect it.
It's essentially a step up from my own experience studying under my mentor. He hasn't mass published anything. If I were to turn around and start putting out his stuff, it would be a departure from the way he wants to go -- namely, to have potential students come directly to him.
Keep in mind that it's not just respectful to the creator to honour their wishes this way, but also the students who might have bought into this as well. If I purchased a book from somebody on the agreement that the material not be shared in any way with other magicians, and somebody else bought that same book, and didn't honour that agreement, then not only does the book's writer get screwed, but the faithful customers do as well.
Thanks Andrew, I am curious tho', who is Jerry to decide who that audience is? If he sells it then he should accept the reality that people are going to perform it, and he has no right to dictate to whom they perform it.
ReplyDeleteYour mentor is a different story as he has not mass published anything, where as Jerry has, regardless of his posturing about being select, he still takes the money and sells the effects, so trying to retain rights as to where people perform it just shows what a truly pompous ass he really is.
At what point is it changed enough to actually use it? Roland stated he had changed it quite dramatically. It sounds like Jerry is trying to stop any one from ever showing anything that he might have had some influence on.
I'm starting to think that he publishes for nothing more than the money and a feeling of self importance. Good skills no not make up for being a twat.
While I can't justify Jerry's reasoning to any real degree (other than he's always been like this) I will say that saying Jerry publishes for money and self-importance is the furthest thing from the truth.

ReplyDeleteNot knowing Jerry, I can't say for certain exactly what he's thinking or why he does what he does. I can only speculate.
ReplyDeleteThat said, there's something refreshing about an old-school attitude where magicians have to work to see things, and creators do what they can to make sure not just any other magician can see the work.
According to a book on rope magic whose title I forget and am too lazy to look up, back in the day, UF Grant had a rope trick he'd never do around magicians. The description of that rope trick that regular people would make trumped most traditional cut and restored ropes could do. If magicians saw it, maybe they'd see the method straight away. Instead, he made sure to frustrate them for as long as he could. That rope trick has a significant feature that most methods allow for. I don't know how good it looked, and in all likelihood the descriptions of it were far more flattering than what was going on. That said, a hopeful imagination could easily picture a miracle.
I like this sort of thing very much. It's frustrating, but with all this information we have so much easy access to, it's nice to think that some things are still unattainable.
Incidentally, I want to make it clear that I think Roland's DCT project is fantastic, and that it really sucks if he put work into a video only to have it taken down.

Und ich an deiner Stelle würde die Herausforderung annehmen, und gleiches mit gleichem bekämpfen. Das wieder also wieder aktivieren, einspruch erheben, und sogar online lassen, und bloß seinen Namen entfernen, bzw nur noch Initialen da lassen.

Sure enough the guy that parodies my site copied the video, over dubbed the audio, and left it up.
Here's the thing in my world. I only wanted those videos to be up for 24 hours. I HIGHLY believe that most card magic is indirect exposure when it's put on video and can be played over and over at youtube.
Thus. Though my wishes were to put something up for a mere 24 hours with a mild point we all could learn from, it was copied and linked by dick heads like Tim Ellis.
Point blank is the magic world is full of assholes. I don't think Jerry is trying to be one. I assume he's just had many bad experiences somewhat in the realm of my piddly story.
I can't blame the guy for thinking card magic isn't in it's best form on youtube.
I enjoy it like the next guy, yet I understand both sides. It's a battle I can see most of us being divided about when it all boils down.
I get amused imagining the court case of such. Talk about a room full of guys that are proving their life has been void in some manner.
